TEXT ORDER: This matter comes before the Court on Petitioner's motion for a temporary restraining order seeking an Order directing Respondents to return Petitioner to the United States and restore his pre-removal status. (ECF No. 8.) The Court cannot resolve the issues on the current record. By Wednesday, February 11, 2026, at 12 noon p.m., Respondents are hereby ORDERED to file a written response to the TRO motion that includes their legal arguments and all available evidence that supports the timeline they provided in their letter dated January 27, 2026. It is FURTHER ORDERED that Respondents written response shall include certifications from the ICE officials who escorted Petitioner (1) from Newark to Texas on January 24, 2026, and (2) from the ICE facility in Port Isabel Texas to the Port of Entry at Brownsville/Matamoras, Texas on January 25, 2026. TEXT ORDER: This matter comes before the Court on Petitioner Estanislao Carrazco Munoz's petition for a writ of habeas corpus (ECF No. 1, Petition ) and motion for an order to show cause (ECF No. 8, Motion for OTSC) in which Petitioner requests that Respondents immediately return Petitioner to the United States following Petitioner's voluntary departure to Mexico on January 25, 2026. The motion (ECF No. 8) is DENIED. Petitioner asserts that his transfer outside New Jersey and his departure from the United States occurred in violation of this Court's Order (ECF No. 3, Order) enjoining such transfer. Respondents submitted evidence certifying that Petitioner voluntarily departed the United States on foot via the Brownsville and Matamoros Gateway Bridge Port of Entry at approximately 11:25 AM (CST) (12:25 PM EST) on January 25, 2026. (ECF No. 10-3, Declaration of Jason L. Feliciano at 2 8.) The Court's Order (ECF No. 3) enjoining Respondents from transferring Petitioner was entered at 1:28 PM EST on January 25, 2026. (ECF No. 10-4, Notice of Electronic Filing.) Respondents, therefore, did not act in violation of this Court's Order, and Petitioner is not entitled to the relief sought before this Court to order his return to the United States. Petitioner's habeas petition under 28 U.S.C. § 2241 (ECF No. 1) is DISMISSED as moot based on his release from detention. See Vasquez v. Aviles, 639 F. App'x 898, 902 (3d Cir. 2016) (holding noncitizen's challenge to the legality and length of his detention was moot upon his removal from the United States); Kurtishi v. Cicchi, 270 F. App'x 197, 199-200 (3d Cir. 2008) (same). It is ORDERED that the Clerk of the Court shall CLOSE this matter. So Ordered by Judge Katharine S. Hayden on 8/12/26. (cm, ) (Entered: 08/12/2026)
