As stated during todays telephonic conference, the Petition (Dkt. No. 1) is GRANTED. ICE is ORDERED to immediately release Petitioner, no later than 5 PM today. In accordance with todays oral ruling, ICE may impose conditions, but ICE should not subject Petitioner to ankle monitoring unless a neutral decision maker determines that it is necessary because petitioner is a flight risk or danger to the community. Petitioner should not be re-detained without being provided notice and opportunity to be heard at a bond hearing before a neutral decision maker at which the government would bear the burden of showing his detention is authorized under 1226. Respondents are further ORDERED to certify compliance with this Order by 2 PM tomorrow, February 5, 2026. (HEREBY ORDERED by Judge Andrew L. Carter, Jr) (Text Only Order) (Carter, Andrew) (Entered: 02/04/2026)
