TEXT ORDER: The Court has considered the requested relief, and Petitioner's Motion for a Temporary Restraining Order ("TRO Motion") (ECF No. 8 ) is GRANTED as follows. Respondents are temporarily enjoined from transferring Petitioner from this District pending further Order of the Court. The Court's intent in granting the TRO Motion is to preserve the status quo until the Court can resolve the petition and not to prevent Respondents from executing Petitioner's removal order, an issue over which it does not have jurisdiction. See Tazu v. Att'y Gen., 975 F.3d 292, 297 (3d Cir. 2020). By Monday, April 13, 2026 at 12 p.m., Respondents shall file a status update, confirming that Petitioner is still detained Delaney Hall, which the Immigration and Customs Enforcement Locator lists as his current detention facility. Considering the length of Petitioner's detention, the status update shall also (1) provide updated evidence regarding Respondents' efforts to remove Petitioner, and (2) address whether this evidence is sufficient to rebut Petitioner's claim of prolonged detention. See Zadvydas v. Davis, 533 U.S. 678, 701 (2001). Petitioner's counsel may file a reply to the status update by Wednesday, April 15, 2026 at 12 p.m. So Ordered by Judge Robert Kirsch on 04/10/2026.
