The Court previously ordered that upon release of Petitioner, Respondents "shall return to Petitioner his government issued identification documents, as well as any other lawfully issued documents or property seized from him." (Doc. # 9 .) Respondents retained Petitioner's property upon release. The Court subsequently ordered "Respondents immediately return Petitioner's items and documents to him or provide the Court and Petitioner's counsel with status updates until Petitioner's property is returned." (Doc. # 13 .) Respondents have not returned Petitioner's legal identification documents or provided status updates. Therefore, it is hereby ORDERED that Respondents immediately return to Petitioner his government-issued identification documents and other lawfully issued documents. TEXT ORDER: On February 10, 2026, the Court presided over a video conference hearing. Pursuant to the hearing, Respondents are directed to provide affidavits of government officials to the Court and Petitioner's counsel within 48 hours, identifying who is responsible for ensuring the return of Petitioner's property and the steps that have been taken to ensure the return of Petitioner's property. Respondent's counsel shall also provide a copy of this Order to counsel for OPLA. The Court further orders Ms. Cassandra Bly and the other counsel mentioned in the hearing to also provide affidavits, attaching relevant email communications, detailing all communications involving the return of property, and identifying all individuals at ERO who were provided information about the Court's order. Additionally, Respondent's counsel shall provide this Order to the individual at ERO with custody of the property and that individual is ordered to appear at the next hearing.
