Judge Indira Talwani: ELECTRONIC ORDER: On February 3, 2026, the court granted Petitioner Matondo Andre Mateus’s Petition for Writ of Habeas Corpus [ 1 ] and Emergency Motion for [a] Temporary Restraining Order [ 8 ] and directed Respondents to return Petitioner to the District of Massachusetts from the District of Arizona within 72 hours and either release Petitioner from custody or, no later than February 10, 2026, provide her with a bond hearing pursuant to 8 U.S.C. § 1226. Mem. & Order 4 [ 9 ]. Respondents elected to release Petitioner on February 5, 2026, and provided her with “a commercial flight from Phoenix, Arizona to Boston, Massachusetts on that same date.” Status Rep. 1 [ 10 ].On February 11, 2026, Petitioner filed a Motion for Return of Property [ 11 ]. In that Motion [ 11 ], Petitioner requested that the court direct Respondents to return items confiscated from her when she was taken into custody, including Petitioner’s cell phone, debit cards, Employment Authorization Document and driver’s license. Id. at 2–4. In a Status Report [ 12 ], Petitioner informed the court that her cell phone and debit cards were returned on February 23, 2026.Pursuant to Local Rule 7.1(b)(2), a party opposing a motion shall file an opposition within fourteen days after the motion is served. Accordingly, any opposition to Petitioner’s Motion for Return of Property [ 11 ] was due on February 25, 2026.Where the Motion for Return of Property [ 11 ] is unopposed, Respondents shall return Petitioner’s driver’s license and Employment Authorization Document to her no later than March 6, 2026.
