ORDER granting in part 1 petition for a writ of habeas corpus; directing petitioner to file a motion seeking a bond hearing and the bond hearing shall be held within 10 days. The parties shall file a status report as soon as possible following the bond hearing before the immigration judge, but in any event no later than within seven days of the bond hearing. If Alvarez is not provided a bond hearing, at which the merits of her request for release are reached, within 10 days of the filing of her motion, the respondents shall release Alvarez from detention, and such release shall be subject to the same conditions that applied before Alvarez's January 22, 2026 arrest. PAPERLESS ORDER: In her reply filed yesterday, ECF 14, the petitioner informs the Court that she was granted voluntary departure by the immigration judge three days ago. The attached order of the immigration judge specifies that this voluntary departure shall be "under safeguards." ECF [14-1], at 4. "[T]he term 'voluntary departure with safeguards' is commonly used to characterize the requirement that a [noncitizen] remain in custody until he or she departs from the United States." Matter of M-A-S-, 24 I&N Dec. 762, 766 (BIA 2009); see also Matter of Javier Salazar Rojo, No. AXXX-XX6-903, 2023 WL 9503619, at *1 n.1 (BIA Jul. 18, 2023) ("The Immigration Judge granted the respondent 'voluntary departure under safeguards,' meaning that the respondent would remain detained until his departure."). The Court will hold a call with the parties on the afternoon of March 4, 2026 to discuss the petitioner's release request. By March 3, 2026, the respondents shall submit their position on how the immigration judge's recent grant of voluntary departure under safeguards impacts this case. Signed by Judge Deborah L.
