Judge Brian E. Murphy: ELECTRONIC ORDER entered. Petitioner alleges that she is being held by Immigration and Customs Enforcement despite no pending removal proceedings or associated process. Judge Brian E. Murphy: ELECTRONIC ORDER entered. Pursuant to 28 U.S.C. s. 2242, counsel for Petitioner has attested to the facts as stated in the Petition, Dkt. 1 at 12, including that Petitioner is being detained by Immigration and Customs Enforcement despite no pending removal proceedings or associated process, id. paras. 4-6. See also Dkt. 7 para. 3 (“[T]he Notice to Appear issued by DHS was utterly defective, listing the wrong name, wrong country of nationality, wrong date of birth, and no charges of removability; the Immigration Judge ordered DHS to file a corrected NTA within seven days; DHS failed to comply; and at the next hearing DHS still had not complied, and the Immigration Judge granted Petitioner’s motion to terminate proceedings.”). Yesterday afternoon, in an emergency motion, Petitioner stated, among other things, that since January 22, 2026, she has been detained with “no bed and no mattress,” “little food,” and with minimal opportunity to speak to family or confer with counsel. Id. para. 5. This morning, the Court directed Respondents to verify the “basic facts” of the Petition, chiefly, whether it was correct that Petitioner was being held in the absence of any removal proceedings that might, pending other details, authorize her detention. Dkt. 9 . Respondents have not filed any response within the time allotted or as of this order. Accordingly, the Court concludes that there is no lawful basis for Petitioner’s detention, GRANTS this Petition, and ORDERS that she be released immediately. (MBM) (Entered: 01/29/2026)
