TEXT ORDER: Petitioner alleges she is detained under § 1226(a) without a bond hearing. It is ORDERED that, in accordance with 8 U.S.C. § 1226(a), no later than 5:00 p.m. on February 4, 2026, Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether she presents a flight risk or a danger to the community. Within three (3) days of that bond hearing, Respondents shall file a written notice of the outcome of that hearing with this Court. If Respondents contend that Petitioner's detention is distinguishable from the cases in this district previously addressing §1226(a), they shall file an expedited answer by 12:00 p.m. on February 3, 2026, and Petitioner shall file a reply by 5:00 p.m. on February 3, 2026. TEXT ORDER: Petitioner seeks habeas relief pursuant to 28 U.S.C. § 2241. (ECF No. 1.) Habeas jurisdiction requires that a petitioner be "in custody" at the time the petition is filed. Kumarasamy v. Att'y Gen., 453 F.3d 169, 172-73 (3d Cir. 2006) (holding that a noncitizen who had already been removed from the United States was not "in custody" for purposes of § 2241 habeas jurisdiction). Petitioner alleges that he was removed from the United States on or about November 24, 2025. (ECF No. 1 8, 20.) Because the Petition was filed on January 20, 2026, Petitioner was not in custody at the time of filing, and the Court therefore lacks jurisdiction. Accordingly, the Petition (ECF No. 1) is DISMISSED for lack of jurisdiction, and any pending or ancillary filings, including Petitioner's Application for Admission Pro Hac Vice (ECF No. 2) and the accompanying Certificate of Good Standing (ECF No. 3) are DISMISSED AS MOOT.
