(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner asserts the action is not moot because the bond hearing provided was constitutionally inadequate. The parties are ordered to meet and confer on whether Petitioner's claim may be resolved by providing him with another bond hearing that addresses his concerns, including that both Petitioner and his counsel are present at the hearing. The parties shall file a joint status report by February 26, 2026. To the extent that Petitioner requests the Court to review the immigration judge's determination, that request is denied on this record. In requesting review, Petitioner relies on Martinez v. Clark, 124 F.4th 775, 779 (9th Cir. 2024) (noting that an agency determination of dangerousness is reviewable), but fails to address Leonardo v. Crawford, 646 F.3d 1157, 1160 (9th Cir. 2011) (noting that an immigration detainee "dissatisfied with the IJ's bond determination" must exhaust administrative remedies by filing an appeal to the Board of Immigration Appeals).
