TEXT ORDER : This matter is before the Court on Petitioner's April 23, 2026 Letter, (D.E. No. 21 ("April 23, 2026 Letter")), and July 31, 2026 Letter, (D.E. No. 22 ("July 31, 2026 Letter")). The Court notes that, in the July 31, 2026 Letter, Petitioner's counsel states that, "[a]s set forth in his Petition and briefing, Mr. Perez has been unlawfully and unconstitutionally detained by ICE since January 18, more than six months ago." (July 31, 2026 Letter at 1 (emphasis added)). Within seven (7) days of the date of entry of this Text Order, Petitioner shall file a submission stating whether, given the length of his detention, which exceeds the presumptively reasonable six-month period of detention, he is asserting a claim under Zadvydas v. Davis, 533 U.S. 678 (2001), and, if so, shall address whether he meets his initial burden of showing "good reason to believe that there is no significant likelihood of removal in the reasonably foreseeable future," id. at 701. Within seven (7) days of the filing of Petitioner's submission, Respondents shall file a response to Petitioner's submission, the April 23, 2026 Letter, and the July 31, 2026 Letter. If Petitioner raises a Zadvydas claim, Respondents shall address in their response whether Petitioner has provided good reason to believe there is no significant likelihood of removal in the reasonably foreseeable future and present any evidence rebutting that "good reason" showing, Zadvydas, 533 U.S. at 701.
