ORDER: Upon review of Petitioner's Verified Petition for Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241 1 and Motion for Order to Show Cause 5 the facts of this case appear to be controlled by the Court's recent analysis in Mendoza Gutierrez v. Baltasar, No. 25-CV-2720-RMR, 2025 WL 2962908, at *1 (D. Colo. Oct. 17, 2025). Petitioner appears to be a member of the class of individuals the Court conditionally certified and enjoined the Government from removing from the United States or transferring from the District of Colorado in Gutierrez v. Baltasar, No. 25-CV-2720-RMR, 2025 WL 3251143, at *3 (D. Colo. Nov. 21, 2025).It is ORDERED that Respondents shall promptly enter their notices of appearance. Within seven days of this ORDER, Respondents shall RESPOND to the Application and Motion and SHOW CAUSE why the Petition and Motion shall not be granted. In their Response, Respondents must address whether Petitioner is a member of the class in Gutierrez and confirm that pursuant to this Court's order in Gutierrez, Petitioner will not be removed from the District of Colorado or the United States unless or until this Court or the Court of Appeals for the Tenth Circuit vacates the Court's order in Gutierrez.
