TEXT ORDER: The Emergency Petition for Writ of Habeas Corpus before the Court asserts Petitioner is currently detained at the Plymouth County Correctional Facility in Massachusetts. ECF No. 1 ¶ 15. As such, the District of Rhode Island does not have jurisdiction to adjudicate this petition. See Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004) ("The plain language of the habeas statute... confirms the general rule that for core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement."); Thompson v. Barr, 959 F.3d 476, 491 (1st Cir. 2020) (transferring a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2241 to the district where petitioner was confined). In July of 2023, ICE released petitioner Souvanh Keosouvanh under an Order of Supervision because it was unable to effect his removal to Laos (which does not have any repatriation agreement with the US). Dkt # 17-1 at 4. His release (and the subsequent revocation of that release) accordingly is governed by 8 C.F.R. § 241.13.Section 241.13 authorizes ICE "to re-detain a noncitizen like [petitioner] who has been granted supervised release" when there has been "(1) an individualized determination (2) by ICE that, (3) based on changed circumstances, (4) removal has become significantly likely in the reasonably foreseeable future." Kong v. United States, 62 F.4th 608, 61920 (1st Cir. 2023), citing § 241.13(i)(2). Here, ICE premises petitioner's re-detention on "changed circumstances." Dkt # 17-1 at 1. It does not, however, indicate what those changed circumstances are or how they make removal significantly likely in the reasonably foreseeable future. Respondents therefore are ordered to file a reply of no more than seven (7) pages elaborating on the factual basis for their assertion of changed circumstances.
