ORDER denying 18 Urgent Motion Requesting Order to Stay Transfer of Petitioner and To Hold a Hearing to Show Cause. Pursuant to 8 U.S.C. § 1226(e), this Court does "not have jurisdiction to review a claim 'that an [Immigration Judge or] IJ, exercising [their] statutorily delegated discretion, set an excessively high bond amount.'"Garcia v. Hyde, No. 25-CV-585, 2025 WL 3466312, at *5 (D.R.I. Dec. 3, 2025) (citing Hernandez v. Sessions, 872 F.3d 976, 987 (9th Cir. 2017)).That power of review rests with the administrative immigration courts. Decisions of Immigration Judges "may be appealed to the Board of Immigration Appeals [(BIA)]." 8 C.F.R. § 1003.38(a). This Court's authority to review immigration bond determinations through a writ of habeas corpus arises only after the Petitioner has properly exhausted the available administrative remedies, absent an exception, and only where a constitutional or purely legal defect in the bond decision-making process is identified. See Goncalves v. Reno, 144 F.3d 110, 120, 133 (1st Cir. 1998) (concluding that habeas jurisdiction permits district courts to review at least "pure issues of law concerning the applicability of statutory provisions" in immigration matters); Raspoutny v. Decker, 708 F. Supp. 3d 371, 379 (S.D.N.Y. 2023) (stating that 28 U.S.C. § 2241 permits federal courts to review "purely legal statutory and constitutional claims" arising from immigration proceedings, but that such jurisdiction "does not extend to review of discretionary determinations by the IJ and the BIA"). None of these jurisdictional prerequisites appear to have been satisfied in this case. Accordingly, while the Court is sympathetic to Petitioner's limited financial means and to the expressed desire not to be transferred outside this jurisdiction, the governing statutory and regulatory framework does not permit this Court to intrude upon or displace the authority vested in the administrative immigration courts.
