ORDER re 1 Petition for Writ of Habeas Corpus. Generally, a petitioner must file a habeas petition in the district of confinement. 28 U.S.C. § 2241; Rumsfeld v. Padilla, 542 U.S. 426, 442 (2004); Ozturk v. Trump, 777 F. Supp. 3d 26, 35 (D. Mass. 2025). At 6:00 p.m. on January 20, 2026, Petitioner arrived at an ICE detention center in Burlington, Massachusetts. ECF No. 6 . At 10:18 p.m. that same day, Petitioner filed this habeas petition in this Court. On January 22, Respondents moved to dismiss, arguing that the District of Maine lacks jurisdiction because Petitioner was confined in the District of Massachusetts at the time of filing; Petitioner did not respond. The Court nonetheless takes judicial notice that Petitioner filed a separate habeas petition in the District of Massachusetts on January 22 and stated in that petition that he was detained in Massachusetts. Because the District of Maine was not Petitioner's district of confinement at the time of filing, the Court DISMISSES Mr. Carneiro's petition. ECF No. 1 . By JUDGE STACEY D. NEUMANN.
