MINUTE ORDER (Text Entry Only) The Court has reviewed the Petition filed under 28 U.S.C. § 2241 (Doc. 1) and the related request for emergency injunctive relief (Doc. 5). Petitioner asserts that he has been detained since October 2025 (Doc. 5-1 at 2), more than 4 months ago. He fails to explain his delay in seeking his request for a temporary restraining order or why despite this delay, the Court should treat the situation as an emergency. Thus, the TRO request is untimely, and it is DENIED. Local Rule 231(b). Petitioner seeks a preliminary injunction in the alternative. (Doc. 5) Based on the current record, it appears Petitioner is likely to succeed on at least one of his claims and that some form of immediate relief may be appropriate. Thus, pursuant to 28 U.S.C. § 2243, Respondents are ordered to show cause in writing no later than February 13, 2026 why the Court should not grant Petitioner's motion for a temporary restraining order. Any response SHALL provide the Court with copies of referenced/relevant portions of Petitioner's A-File and other supporting documents, including available documentation related to any asserted violations of release conditions. Petitioner may file a reply no later than February 27, 2026. The Court further directs the parties to indicate on or before their respective filing deadlines (1) whether they are requesting a hearing; and (2) whether they seek additional briefing on the merits of the petition. Depending on the content of the filings, the Court may set a hearing or may rule on the papers.In the meantime, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the exigent circumstances, the Court finds that this order is warranted to maintain the status quo pending the hearing and any subsequent order and finds that Petitioner has satisfied the factors governing the issuance of such preliminary relief signed by District Judge Jennifer L. MINUTE ORDER (Text Entry Only) The Court has received and reviewed the recently filed motion for a preliminary injunction (Doc. 7, filed Jan. 28, 2026), which requests interim relief in the form of immediate release pending the Court's review of a previously filed request for injunctive relief. (See Doc. 5, filed Jan. 23, 2026). The Court declined to treat the January 23, 2026 motion as an emergency on shortened time, converted it from a request for a TRO to a request for a preliminary injunction, and set a briefing schedule that will conclude on February 27, 2026. (Doc. 6 .) The January 28 filing is, in effect, an attempt to get the Court to reconsider its prior order. To be clear, to afford Petitioner the kind of relief requested in his January 28, 2026 filing would require the court to address his motion on shortened time--the exact relief the Court denied on January 23. This kind of procedural maneuver multiples the proceedings and slows down the Court's ability to provide the injunctive relief sought by Petitioner and many others similarly situated. Thus, the renewed motion (Doc. 7 ) is DENIED as an unsupported and unwarranted request for reconsideration. Instead, if Petitioner wishes to speed up the process, counsel may may file a reply (or a waiver of the right to file a reply) related to the January 23, 2026 motion at any time after the opposition deadline expires signed by District Judge Jennifer L.
