MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 1/27/2026: The court has reviewed Petitioner's 1 Petition for Writ of Habeas Corpus and 4 Motion for a Temporary Restraining Order. In that Motion, Petitioner separately states that he was detained on 9/6/2025, and on 10/25/2025. (Doc. No. 4 at 2, 9.) Under either detention date, Petitioner has been detained for over 90 days before filing the Motion. Notably, Local Rule 231(b) states: "In considering a motion for a temporary restraining order, the Court will consider whether the applicant could have sought relief by motion for preliminary injunction at an earlier date without the necessity for seeking last-minute relief by motion for temporary restraining order." On the [4-2] TRO Checklist, Petitioner indicates that there has been no undue delay in bringing this Motion, and that the Motion could not have been brought earlier, but Petitioner does not provide an explanation. Accordingly, the court DENIES Petitioner's 4 Motion for a Temporary Restraining Order, without prejudice, and REFERS this matter to the assigned Magistrate Judge for further proceedings pursuant to Local Rule 302(c).
