Jan 28, 2026
District Judge Angel Kelley: ELECTRONIC ORDER entered. Petitioner's First Motion for a Temporary Restraining Order [Dkt. 11] is DENIED WITHOUT PREJUDICE. On January 20, 2026, this Court entered an Order Concerning Service of Petition, Stay of Transfer or Removal, and Required Response. [Dkt. 4]. In relevant part, the Court's Order provides both that: (1) "Petitioner shall not be transferred to another district unless the government provides advance notice of the intended move" and (2) "Petitioner shall not be deported, removed, or otherwise transferred outside the United States until further Order of this Court." [Dkt. 4 at 4]. As a result, any additional temporary restraining order is unnecessary at this time.Notwithstanding the above, should Respondents provide written notice 96 hours in advance of a transfer, as required by the Order, the Court will consider a relevant temporary restraining order to prevent the transfer at that time. District Judge Angel Kelley: ELECTRONIC ORDER entered. The Court has now received the Petitioner's Objection [Dkt. 16] to the Respondent's Notice [Dkt. 14], as well as an Emergency Motion for Temporary Restraining Order [Dkt. 17]. In order to give the Court an opportunity to consider whether it has subject-matter jurisdiction, and if so, to determine the validity of the Motion, the court may order Respondents to preserve the status quo. See United States v. United Mine Workers of Am., 330 U.S. 258, 293 (1947) (ruling that the District Court ha[s] the power to preserve existing conditions while it [is] determining its own authority to grant injunctive relief, unless the assertion of jurisdiction is frivolous). Such an order is valid unless and until it is overturned, even when the issuing court lacks subject-matter jurisdiction to determine the merits of the underlying action. See id. at 294-95. That principle applies with even greater force where the action the court enjoins would otherwise destroy its jurisdiction or moot the case. See United States v. Shipp, 203 U.S. 563, 573 (1906).To provide an opportunity for a fair and orderly consideration of this matter and resolve any contested issues about jurisdiction, and unless otherwise ordered by the Court, it is hereby ORDERED:The Petitioner shall not be moved out of the District prior to 5:00 PM on Monday, March 23, 2026.Petitioner shall not be deported, removed, or otherwise transferred outside the United States until further Order of this Court.Respondents are ORDERED to respond to the Petitioner's Objection and Motion for Temporary Restraining Order no later than 5:00 PM on Thursday, March 19, 2026. re 17 Emergency MOTION for Temporary Restraining Order filed by Robson Lima Ramos, ( Status Report due by 3/19/2026)(MS) (Entered: 03/17/2026)

District Judge Angel Kelley: ELECTRONIC ORDER entered. In Respondents' Response to Petitioner's Emergency Motion for Temporary Restraining Order [Dkt. 17], they agree that the filing of a motion to reopen an in absentia removal order requires the stay of the removal. [Dkt. 19 ¶ 4]. “Accordingly, Respondents hereby withdraw their notice of intent to transfer Petitioner to effectuate his removal.” [Id. ¶ 5].As a result, Petitioner's Emergency Motion for Temporary Restraining Order [Dkt. 17] is DENIED AS MOOT. The Court’s Order Concerning Service of Petition, Stay of Transfer or Removal, and Required Response [Dkt. 4] remains in force. Should Respondents intend to transfer Petitioner at a future date, a notice must be filed 96 hours in advance of any intended transfer. [Id. at 4]. Again, Petitioner shall not be deported, removed, or otherwise transferred outside the United States until further Order of this Court. [Id.].(CEH) (Entered: 03/20/2026)
