TEXT ONLY ORDER/NOTICE TO ATTORNEY. Respondents are ordered to file an answer to the Petition for Writ of Habeas Corpus (Doc. No. 1 ) on or before January 20, 2026, at 12:00 p.m. CT, certifying the true cause and proper duration of Petitioner's confinement and showing cause as to why the writ should not be granted in this case. The response should include a reasoned memorandum of law and fact addressing each count of the Petition, as well as any supporting documentation that may be needed to establish the lawfulness of Petitioner's arrest and/or continued confinement. No reply will be permitted, and the Court will decide the Petition without a hearing and based on the written submissions. MEMORANDUM, OPINION AND ORDER: Petitioner's petition for writ of habeas corpus (Doc. No. 1 ) is GRANTED. The Court DECLARES that Petitioner's current detention is unlawful under the Constitution and laws of the United States. Respondents are ORDERED to release Petitioner from custody immediately. Within three (3) days of the date of this Order, the Government shall provide the Court with a status update confirming Petitioner's release. Within thirty (30) days of final judgment in this action, Petitioner may move to recover attorneys' fees and costs under the Equal Access to Justice Act, 28 U.S.C. § 2412(d).
