Minute Order by Judge Jinsook Ohta: Petitioner Murat Edis, a federal immigration detainee currently confined at the Mesa Verde Detention Center, filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. Dkt. 1. A habeas petition brought under § 2241, including those filed by individuals in immigration detention, must be filed in the district where the petitioner is presently confined. See Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004) ("[F]or core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement."); Doe v. Garland, 109 F.4th 1188, 1199 (9th Cir. 2024) (applying Padilla's district-of-confinement rule to a § 2241 petition filed by an immigration detainee). Here, Petitioner is detained at the Mesa Verde Detention Center in Bakersfield, Kern County, California, which is located within the Eastern District of California. Because jurisdiction over this habeas petition lies in that district, the Court finds that transfer is warranted in the interest of justice and judicial economy. See Miller v. Hambrick, 905 F.2d 259, 262 (9th Cir. 1990) (holding that, pursuant to 28 U.S.C. § 1631, a court lacking jurisdiction should transfer an action to a court where it could have been brought when doing so is "in the interest of justice"). Accordingly, the Court ORDERS the Clerk of the Court to transfer this matter to the United States District Court for the Eastern District of California and to serve a copy of this Order on Petitioner and the United States Attorney.
