MINUTE ORDER signed by District Judge Kirk E. Sherriff on 3/13/2026: (Text Only Entry): The 11 motion for temporary restraining order is denied. Petitioner argues that his detention is governed by 8 U.S.C. § 1226(a), see Doc. 11, but he has been subject to a reinstated order of removal since December 6, 2018, see Doc. 9-1, Ex. 12. The detention of a noncitizen subject to a reinstated order of removal is governed by 8 U.S.C. § 1231, even when the noncitizen is in withholding-only proceedings. See Padilla-Ramirez v. Bible, 882 F.3d 826, 830-33 (9th Cir. 2017); Johnson v. Guzman Chavez, 594 U.S. 523, 532-39 (2021). Petitioner's motion fails to address § 1231, the statute which governs his detention, or 8 C.F.R. §§ 241.4(l) and 241.13(i), the regulations which authorize the government to re-detain a noncitizen who has previously been released from detention following a final order of removal. The petition is referred to the assigned magistrate judge for further proceedings, including the preparation of findings and recommendations on the petition or other appropriate action.
