MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 1/21/2026: The court has reviewed Petitioner's 2 Petition for Writ of Habeas Corpus and 1 Motion for Temporary Restraining Order, Respondents' 7 Opposition to Petitioner's Motion for Temporary Restraining Order, and Petitioner's 8 Reply thereto. As an Exhibit to their Opposition, Respondents attach Petitioner's immigration records, which reflect that Petitioner was detained by ICE in May 2025. (See Doc. No. 7-1.) Further, as reflected in the "Order of Immigration Judge" that Petitioner attached as an Exhibit to his Petition, the Immigration Judge's denial of Petitioner's request for custody redetermination was issued in July 2025. (See Doc. No. 2-1 at 20.) Petitioner does not address why he did not request emergency relief earlier, given that the events precipitating his request for relief took place over six months ago. Notably, Local Rule 231(b) states: "In considering a motion for a temporary restraining order, the Court will consider whether the applicant could have sought relief by motion for preliminary injunction at an earlier date without the necessity for seeking last-minute relief by motion for temporary restraining order." On his [2-1] TRO Checklist, Petitioner indicates that there has been no undue delay in bringing this Motion, and that the Motion could not have been brought earlier, but states only that the "petition and motion were filed promptly after a new attorney was retained following ICE's continued detention and the Immigration Judge's order... which eliminated bond jurisdiction and made immediate intervention necessary." (See Doc. No. 2-1 at 188.) Petitioner does not otherwise address the six-month delay in seeking relief. Accordingly, the court DENIES Petitioner's 1 Motion for a Temporary Restraining Order, without prejudice, and REFERS this matter to the assigned Magistrate Judge for further proceedings pursuant to Local Rule 302(c).
