FINAL ORDER. It is ORDERED that the court ADOPTS and APPROVES the findings and recommendations set forth in the 29 Report and Recommendation. It is therefore ORDERED that the 25 Amended Petition is GRANTED, and that Petitioner be released from cu stody subject to conditions of his existing parole, except for any time limitation periods. The original Report and Recommendation is DISMISSED as MOOT. It is further ORDERED that Respondents are ENJOINED from rearresting Petitioner solely based on the expiration of his parole; and are ENJOINED from rearresting Petitioner unless (1) he commits a violation of any federal, state, or local law; (2) he fails to comply with conditions of his parole unrelated to its expiration; or (3) his parole has been lawfully revoked in a manner consistent with 8 C.F.R. 212.5(e). Respondents SHALL file a status report with the Court within THREE DAYS of Petitioner's release. It is further ORDERED that judgment be entered in favor of Petitioner.
