TEXT ORDER: On January 15, 2026, petitioner filed a petition for writ of habeas corpus which asks this Court to Order his immediate release from custody/detention. See generally ECF No. 2 . The Government responded on January 28, 2026 and argued for dismissal on several grounds, including that the petition fails to satisfy the pleading standards set forth in Fed. R. Civ. P. 8(a) and lacks any information about when petitioner was most recently detained or how long, cumulatively, he has been detained. ECF No. 8 at 12. After reviewing the petition and response, this Court agrees with the Government. Petitioner failed to include basic information in the petition such as when, why, and how long petitioner has been detained, whether he has requested a bond hearing, and if so, the status of that request or hearing. Counsel has not submitted an amended petition containing any further information despite over two weeks having elapsed since the petition was initially filed. Accordingly, the petition for writ of habeas corpus is DENIED without prejudice. So Ordered by District Judge Melissa R. DuBose on 2/2/2026. (Urizandi, Nissheneyra)

TEXT ORDER: On March 2, 2026, Respondents filed a Notice of Intent to Transfer to Effectuate Removal Order, notifying this Court that on Friday, March 6, 2026, Petitioner will be moved from the District of Rhode Island to another location in preparation for his removal to Guatemala during the week of March 11, 2026. ECF No. 17 . Petitioner's removal is purportedly based on a reinstated removal order and an immigration court's adverse ruling at Petitioner's reasonable fear hearing on February 19, 2026. Petitioner responded to the Notice of Intent to Transfer and indicates he "will file a petition for review with the First Circuit within 30 days of the IJ's February 19 ruling upholding the AO and will also include in that petition the rejection of the motion to reconsider." ECF No. 20 at 2. After reviewing the filings, the Court Orders the Respondents to produce a travel document confirming Petitioner's removal to Guatemala is occurring the week of March 11, 2026. If Respondents are unable to produce a travel document that reflects travel has indeed been booked as intended in the Notice to this Court by 4:30pm today, March 5, then Petitioner shall not be transferred from this district pending 1) resolution of the instant habeas case and 2) expiration of the 30-day period to file with the First Circuit. If the travel document is produced to this Court by 4:30pm then Respondents may proceed with the planned transfer. So Ordered by District Judge Melissa R. DuBose on 3/5/2026. (Urizandi, Nissheneyra)
