ORDER: Based on the Government's representations in its emergency letter to the Court dated July 30, 2025 (ECF No. 5), it appears that at the time of the filing of the petition, Petitioner was in Newark, New Jersey. For the reasons discussed in Ozturk v. Hyde, 136 F.4th 382 (2d Cir. 2025), and Judge Furman's opinion in Khalil v. Joyce, 771 F. Supp. 3d 268 (S.D.N.Y. 2025), it appears likely that the proper venue for this matter is the United States District Court for the District of New Jersey, not this Court. Pending further order by this Court or a transferee court, Respondents are hereby restrained and enjoined from removing Petitioner from the United States. See id. at 292. The conference with the Court scheduled for 3:00 p.m. today, July 31, 2025, will take place telephonically: Counsel and any interested parties should call (855) 244-8681 and enter attendee ID number 2312 828 7066. This Order supersedes and replaces the TRO issued by this Court on July 30, 2025 (ECF No. 3). SO ORDERED. (Telephone Conference set for 7/31/2025 at 03:00 PM before Judge J. Paul Oetken.) TEXT ORDER: This Court is in receipt of Petitioner's motion for leave to appear pro hac vice (D.E. 13 ), motion for temporary restraining order ("TRO") (D.E. 14 ), and civil cover sheet (D.E. 15 ). Petitioner's motion for leave to appear pro hac vice lacks a proposed order as required under Local Civil Rule 7.1(e) and an indication that the attorney seeking admission will make a payment to the Clerk of Court as required by Local Civil Rule 101.1(c)(3). In support of her request for injunctive relief, Petitioner is ordered to file documentation, including arguments and case law. See Winter v. NRDC, 555 U.S. 7, 20 (2008). Petitioner is also ordered to advise as to Petitioner's current status, including any changes to her location or conditions since July 30, 2025. Petitioner is also ordered to promptly serve the motion for TRO on Defendants or certify in writing any efforts made to give notice and the reasons why it should not be required. Fed. R. Civ. P. 65(b)(1). Finally, Petitioner is advised that the document filed on August 5, 2025 with the docket text "First PETITION for Writ of Habeas Corpus" (D.E. 15 ) contains only a civil cover sheet and accompanying instructions, not a petition for habeas corpus. No hearing shall be scheduled until the outlined information has been filed. So Ordered by Judge Susan D. Wigenton on 8/6/2025. (cds) (Entered: 08/06/2025)
