Petitioner's 1 Petition for Writ of Habeas Corpus be granted on the Fifth Amendment procedural due p rocess claim. The court declare that petitioner's re-detention violated petitioner's rights under the Fifth Amendment Due Process Clause. The court order permanent injunctive relief as follows: Petitioner Harmanpreet S. shall remain out of custody under the same conditions to which he was subject prior to his current detention. Respondents shall not impose any additional restrictions on him, unless such restrictions are determined to be necessary at a future pre-deprivation/custodyhe aring. Respondents are enjoined and restrained from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, including seven-days' notice and a pre-deprivation hearing before a neutral fact-finder where: (a) Re spondents show material changed circumstances demonstrate a significant likelihood of Petitioner's removal in the reasonably foreseeable future, or (b) Respondents demonstrate by clear and convincing evidence that Petitioner poses a danger to th e community or a flight risk. At any such hearing, Petitioner shall be allowed to have counsel present. The court dismiss without prejudice the remaining claims in the habeas petition in the interest of judicial economy since the requested relief has been granted. Petitioner's request for attorney's fees and costs be denied without prejudice to bringing a properly noticed and supported motion. All other pending motions, if any, be denied as moot. ORDER signed by Chief District Judge Troy L. Nunley on 10/5/2026 ADOPTING 18 The Findings and Recommendations in full; DENYING 13 Respondents' Motion to Dismiss. Petitioner's re-detention violated Petitioner's rights under the Fi fth Amendment Due Process Clause, thus, the Petition for a Writ of Habeas Corpus 1 is GRANTED on the Fifth Amendment procedural due process claim. Respondents shall not impose any additional restrictions on Petitioner's release from custod y, unless such restrictions are determined to be necessary at a future pre-deprivation custody hearing. Respondents are ENJOINED from re-detaining Petitioner, while subject to 8 U.S.C. § 1226(a), absent compliance with statutory and constitut ional protections, including a minimum of seven-days' notice and a pre-deprivation hearing before a neutral factfinder where the government must establish by clear and convincing evidence that its interest in protecting the public or ensuring Petitioner appears at future immigration proceedings outweighs Petitioner's constitutionally protected interest in remaining free from detention such that no alternative to detention can mitigate that risk.
