MINUTE ORDER issued by Courtroom Deputy for Chief Magistrate Judge Carolyn K. Delaney on 2/20/2026: As indicated by the district court judge assigned to this case, the Application for Writ of Habeas Corpus before the court does not provide a basis for habeas corpus relief. ECF No. 10 . Petitioner has filed a 15 Motion for Discovery. However, as noted by Respondents' 17 Response, discovery is not appropriate absent allegations amounting to unlawful confinement. Accordingly, the 15 Motion for Discovery is DENIED. Petitioner is GRANTED 30 (thirty) days within which to file an Amended Application for Writ of Habeas Corpus. MINUTE ORDER issued by Courtroom Deputy for Chief Magistrate Judge Carolyn K. Delaney on 3/15/2026: Petitioner (A241-002-586) filed a 1 Petition for Writ of Habeas corpus seeking release from Immigration Customs Enforcement Service (ICE) custody. Counsel for Petitioner has informed the court that Petitioner is no longer in ICE custody as he has left the country for Nicaragua. Since Petitioner's habeas petition is now moot, IT IS HEREBY RECOMMENDED that Petitioner's 1 Petition for a Writ of Habeas Corpus be dismissed, and this case be closed. These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within seven (7) days after being served with these findings and recommendations, any party may file written objections with the court and serve a copy on all parties. Such a document should be captioned "Objections to Magistrate Judge's Findings and Recommendations." Any response to the objections shall be filed and served within seven (7) days after service of the objections. The parties are advised that failure to file objections within the specified time may waive the right to appeal the District Court's order. Martinez v. Ylst, 951 F.2d 1153 (9th Cir. 1991).
