MEMORANDUM ORDER - This matter comes before the Court on Petitioner Abelio Alejandro Sibran-Juares' Petition for Writ of Habeas Corpus (the "Petition") pursuant to 28 U.S.C. § 2241, (ECF No. 1 ). Accordingly, Petitioner is ORDERED to file, within five (5) days of the date of entry hereof, a petition that complies with Rule 2. It is FURTHER ORDERED Respondents SHALL file, within five days of the filing of a compliant petition, either a Notice indicating that the factual and legal issues presented in the compliant petition do not differ in any material fashion from those presented in Duarte Escobar v. Noem, et al., 3:25-cv-758 (E.D. Va.), or an Opposition to the Petition discussing thematerial differences between Duarte Escobar and the compliant petition. It is FURTHER ORDERED that if Respondents file a Notice that there are nomaterial differences between the compliant petition and Duarte Escobar, each of the substantive filings in that habeas proceeding will be incorporated into this habeas proceeding, and this Court will issue a ruling without further filings from the parties. It is FURTHER ORDERED that if Respondents file an Opposition to the compliant petition, the Petitioner shall file any reply in further support of the compliant petition within three days of the date of entry of any Opposition by Respondents. On January 13, 2026, Petitioner filed a Motion for Order to Show Cause, requesting the Court "to issue Respondents an Order to Show Cause within three days why the petition should not be granted", (ECF No. 2, at 2.) Because the Petition has not been properly filed, the Court DENIES the Motion for Order to Show Cause WITHOUT PREJUDICE. Respondents are discouraged from removing or transferring Petitioner from this District for any reason before a decision by this Court on the petition. It is so ORDERED. ORDER - The Court finds that the Amened Petition, (ECF No. 5 ), still does not comply with habeas Rule 2. The Court ORDERS that Mr. Sibran-Juares file an amended petition within five (5) days of the date of this Order that complies with Rule 2 of the habeas rules. The Court ORDERS Respondents to file another Notice, in accordance with this Court's prior Order, (ECF No. 4 ), upon the filing of a compliant petition. MEMORANDUM ORDER - This matter comes before the Court on Petitioner Abelio Alejandro Sibran-Juares' Amended Petition for a Writ of Habeas Corpus under 28 U.S.C. § 2241 (the "Amended Petition"), (ECF No. 8 ). The instant Amended Petition does not comply with Rule 2. Mr. Sibran-Juares did not sign the Amended Petition. Instead, the Amended Petition includes a signed verification from Mr. Sibran-Juares' sister, which states that she submits the Amended petition "on [her] brother's behalf, (ECF No. 8, at 11). The Court finds that the Amended Petition, (ECF No. 8 ), still does not comply with habeas Rule 2. The Court ORDERS that Mr. Sibran-Juares file an amended petition within five (5) days of the date of this Order that complies with Rule 2 of the habeas rules, see Campos-Flores v. Bondi, No. 3:25-cv-797, ECF Nos. 13, 14 (Oct. 31, 2025), or otherwise explains, in more detail, why Mr. Sibran-Juares' detention renders him inaccessible. See Order for details. It is SO ORDERED. ORDER that the Court GRANTS Petitioner Abelio Alejandro Sibrian-Juares' 10 Amended Petition. Respondents are ORDERED to provide Mr. Sibrian-Juares with a bond hearing in front of an Immigration Judge pursuant to 8 U.S.C. § 1226(a). The Court ORDERS that the Immigration Court provide Mr. Sibrian-Juares with the opportunity for a bond hearing prior to any hearing on the merits of his removal, and no later than 3 days from the date of entry of this Order.
