MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on January 21, 2026: Before the Court is Respondents' second motion to extend time to respond to Petitioner's motion for temporary restraining order (TRO). (ECF No. 14 .) Petitioner opposed the requested extension. (ECF No. 15 .) It has been nine days since Respondents were first made aware of Petitioner's motion requesting emergency relief. On January 13, 2026, Respondents were served with Petitioner's motion for TRO. On January 14, 2026, the Court ordered Respondents to file any opposition to the motion for TRO by January 16, 2026. On January 16, 2026, Respondents requested a five-day extension and the Court extended Respondents' time to respond until January 21, 2026 at 12:00 p.m. Respondents now seek an additional seven-day extension "to fruitfully respond to the motion" for TRO in consultation with another federal agency, but does not state why that additional time is necessary or why coordination could not occur within the last nine days. Petitioner suffers harm every day he remains in detention. The Court does not find good cause to justify 15 days to respond to an emergency motion. Such a period exceeds the time permitted to oppose a general civil motion. See L.R. 230(c). Accordingly, Respondents request for a seven-day extension is DENIED in part. Given the lapse in deadline while the Court considered Respondents' motion, the Court GRANTS the parties a one-day extension to respond. Respondents are ordered to file any opposition to Petitioner's motion by 12:00 p.m. on January 22, 2026. Failure to file an opposition by the deadline will be construed as a non-opposition to the motion for TRO. See L.R. 230(c). Petitioner may file a reply, if any, by January 23, 2026. Respondents are reminded of this Court's Order in effect that Respondents shall not transfer Petitioner out of this District while this case is pending. (ECF No. 7 .)
