MINUTE ORDER IN CHAMBERS of the Honorable Judge Cristina D. Silva on 2/13/2026. On January 21, 2026, I issued an order appointing counsel and directing service of Jhoan Yesid Torres Gonzalez's petition for writ of habeas corpus. ECF No. 3 . Therein, the Federal Public Defender (FPD) for the District of Nevada was appointed to represent Torres Gonzalez and was directed to file a notice of appearance (or indicate its inability to represent the petitioner) by January 29, 2026. Id. To date, the FPD has not responded. Accordingly, the deadline for the FPD to file a notice of appearance (or indicate its inability to represent the petitioner) is extended to February 20, 2026. It is further ordered that if the FPD files a notice of appearance in this matter, it will then have 14 days to file an amended petition (or to indicate that an amended petition is unnecessary). ORDER Granting the Petitioner's Amended Writ of Habeas Corpus Petition and Denying the Petitioners Motion for a Temporary Restraining Order. IT IS ORDERED that Torres Gonzalez's petition for writ of habeas corpus [ECF No. 4 ] is GR ANTED. IT IS FURTHER ORDERED that the Torres Gonzalez's motion for a TRO [ECF No. 11 ] is DENIED. IT IS FURTHER ORDERED that the respondents are ordered to release Torres Gonzalez within twenty-four hours, by 6:00 p.m., on May 1, 2026. The petitioner must be released from custody and placed on the order of supervision. Should there be a condition requiring ankle monitoring, then the respondents must show that there has been a finding of a danger to the community or risk of flight. IT IS FURTHER ORDERED that the respondents must endeavor to give the petitioner's counsel at least two-hours notice of petitioner's expected release time. IT IS FURTHER ORDERED that the parties must file a joint status report no l ater than May 8, 2026, advising that status of compliance with this order, and if this matter should remain open or be closed. The status report must include a section from petitioner's counsel advising as to the status of the pending motion to withdraw.
