OPINION - As the duration of Petitioner's detention, the likelihood of continued detention, and the conditions of confinement all weigh in Petitioner's favor, the Court finds, based upon the specific facts of the petitioner's detention before it, that Petitioner detention under § 1226(c) has become unreasonable. "He is thus entitled to a bond hearing to gauge whether he still needs to be detained to keep him from fleeing or committing more crimes." "To justify [Petitioner's] continued detention" "the Government must put forth clear and convincing evidence to support a finding that continued detention is needed to prevent him from fleeing or harming the community[,]"; "[i]f it canno t, it must release him." Therefore, for the foregoing reasons, the Court will GRANT Petitioner's Habeas Petition, ECF No. 1 , in so much as it requests that this Court direct that he be afforded a constitutionally adequate bond hearing bef ore an Immigration Judge and will DENY Petitioner's Habeas Petition, ECF No. 1 , in all other respects. As such, this Court will DENY Petitioner's Motion at ECF No. 6 as moot. The Court will direct Respondents to provide Petitioner a con stitutionally adequate bond hearing before an Immigration Judge within ten (10) days of the entry of this Court's Opinion and Order. An appropriate Order follows, and as more fully stated in said Opinion. Signed by Judge Stephanie L. Haines on 11/7/2025. (dlg)
