Minute Entry for proceedings held before Judge Todd W. Robinson: Motion Hearing held on 2/5/2026. The Court finds that Petitioner's total time in detention exceeds the presumptively reasonable period as defined in Zadvydas v. Davis to show there is no significant likelihood that he will be removed in the reasonably foreseeable future. The Court also finds that Respondents failed to rebut Petitioner's showing. The Petition is therefore GRANTED. Accordingly, Respondents are therefore ORDERED to release Petitioner from detention and restore his conditions of release prior to his re-detention on December 19, 2025. Nothing in this Court's Order should be interpreted as preventing Petitioner's removal to Vietnam, provided Respondents obtain the necessary travel document for Petitioner.
