MINUTE ORDER signed by Magistrate Judge Allison Claire on 03/06/2026. a.The court has reviewed the petition and finds the petitioner, while in pro se, appears to have been asserting an alternative claim for relief based on the revocation of his release on 11/22/25. See ECF No. 1 at 5; see also, e.g., Orellana Gonzalez v. Cerna, No. 1:26-cv-1344 DC JDP (HC), 2026 WL 604193 (E.D. Cal. Mar. 4, 2026); Singh v. Noem, No. 1:26-cv-1150 DC JDP (HC), 2026 WL 585512 (E.D. Cal. Mar. 2, 2026); Pineda v. Chestnut, No. 1:25-cv-1970 DC JDP (HC), 2026 WL 25510 (E.D. Cal. Jan. 5, 2026); D.L.C. v. Wofford, No. 1:25-cv-1996 DC JDP (HC), 2026 WL 25511 (E.D. Cal. Jan. 5, 2026). Counsel has now appeared on petitioner's behalf. Petitioner's counsel is directed to file an amended petition no later than March 10, 2026, stating all claims for relief. The government may respond by March 12, 2026; failure to file a response within the time provided shall be construed as a decision to rest on the answer previously filed. Amended Petition for Writ of Habeas Corpus
#19
Mar 11, 2026
MINUTE ORDER signed by Magistrate Judge Allison Claire on 03/11/2026. The court has reviewed Petitioner's 18 First Amended Petition for Writ of Habeas Corpus. The amended petition states petitioner entered the United States in September 2022, was released from custody the following day, and was re-detained by Immigration and Customs Enforcement on November 22, 2025 without any intervening event that would warrant re-detention. The amended petition asserts a violation under the Immigration and Nationality Act and the Fifth Amendment Due Process Clause, and seeks relief in the form of immediate release, with appropriate conditions of supervision if necessary, or release within five days unless respondents provide petitioner with an adequate bond hearing. Because the court has previously addressed the Due Process issues raised in the amended petition in several cases, respondents shall file a response to the amended petition no later than March 12, 2026, which substantively addresses whether there are any factual or legal issues in this case that materially distinguish it from the court's prior orders in Orellana Gonzalez v. Cerna, No. 1:26-cv-1344 DC JDP (HC), 2026 WL 604193 (E.D. Cal. Mar. 4, 2026); Singh v. Noem, No. 1:26-cv-1150 DC JDP (HC), 2026 WL 585512 (E.D. Cal. Mar. 2, 2026); Pineda v. Chestnut, No. 1:25-cv-1970 DC JDP (HC), 2026 WL 25510 (E.D. Cal. Jan. 5, 2026); D.L.C. v. Wofford, No. 1:25-cv-1996 DC JDP (HC), 2026 WL 25511 (E.D. Cal. Jan. 5, 2026). Petitioner may file a reply by March 13, 2026. (Text Only Entry). (Deputy Clerk JAA) (Entered: 03/11/2026)
