TEXT ORDER: The Court is in receipt of Respondents' status letter dated February 9, 2026, notifying the Court that Petitioner's negative credible fear determination was upheld by the Immigration Judge and that the case was returned "to DHS for removal of Petitioner." (ECF No. 10 at 1.) On January 12, 2026, this Court enjoined Petitioner's transfer from this District and her removal from the United States ECF No. 3, and that Order REMAINS IN EFFECT. The parties are directed to provide supplemental briefing on the following issue: to the extent the Court is barred from reviewing whether Petitioner's expedited removal order is invalid under 8 U.S.C. 1252(e)(2), do the jurisdiction stripping provisions of 8 U.S.C. § 1252 violate the Suspension Clause as applied to Petitioner, who was paroled into the United States, is married to a US citizen, and is in the process of adjusting status to a lawful permanent resident? The parties shall specifically address the Third Circuit's Suspension Clause analysis in Osorio-Martinez v. Attorney General United States of America, 893 F.3d 153 (3d Cir. 2018) and any other relevant decisions. Petitioner and Respondents shall simultaneously submit their briefs by Friday, February 20, 2026, at 12 noon p.m. So Ordered by Judge Katharine S. Hayden on 2/13/26. (cm, ) (Entered: 02/13/2026)
