MINUTE ORDER (Text Only Entry) signed by District Judge Dale A. Drozd on 1/20/2026: Pending the issuance of the court's order resolving the pending 5 motion for a temporary restraining order, and unless and until the court orders otherwise, the court ORDERS that respondents shall not take any action to remove petitioner from the United States or to move petitioner out of the Eastern District of California. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (acknowledging the court's express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction). Given the exigent circumstances present, the court finds that this order is warranted to maintain the status quo pending its forthcoming order resolving petitioner's pending 5 motion for a temporary restraining order. Respondents shall file a written opposition to the pending 5 motion for temporary restraining order by 5:00 PM, tomorrow, 1/21/2026. Any reply filed by petitioner shall be filed by 5:00 PM on Thursday, 1/22/2026. In his reply, petitioner shall provide the following information supported by documentation or declaration where possible: (1) the date of petitioner's most recent detention, and (2) whether petitioner was given notice of the reason for petitioner's re-detention. MINUTE ORDER (Text Only Entry) signed by District Judge Dale A. Drozd on 1/23/2026: On 1/16/2026, petitioner filed a motion for a temporary restraining order. (Doc. No. 5 .) Respondents filed their opposition to petitioner's motion on 1/21/2026 (Doc. No. 7 ) and petitioner filed his reply thereto the same day (Doc. Nos. 8, 9 .) Having considered the circumstances of petitioner's detention and the parties' arguments, the court finds analogous its prior order issued in Ayala Cajina v. Wofford, No. 1:25-cv-01566-DAD-AC (HC), 2025 WL 3251083 (E.D. Cal. Nov. 21, 2025), where the court concluded that due process required a pre-detention hearing to protect the petitioner's liberty interest in his continued release. Here, petitioner appears to have been detained by immigration authorities when he entered the United States on 9/23/2023 and was released on 9/25/2023 and issued a Notice to Appear for removal proceedings. (Doc. Nos. 1 at 4; [1-2] at 2.) Petitioner was re-detained without notice of the reason for his re-detention on 12/6/2025 when he attended a scheduled Immigration and Customs Enforcement check-in. (Doc. No. 8 at 3.) Petitioner alleges that he did not violate any of the conditions of his supervision, and respondents do not dispute this. (Doc. Nos. 7, 8 at 3.) Accordingly, pursuant to the court's reasoning as stated in Ayala Cajina, petitioner's motion for a temporary restraining order (Doc. No. 5 ) is GRANTED, and the court ORDERS the following: (1) Respondents are ORDERED to immediately release petitioner from respondents' custody on the same conditions he was subject to immediately prior to his 12/6/2025 detention; and (2) Respondents are ENJOINED AND RESTRAINED from re-detaining petitioner for any purpose, absent exigent circumstances, without providing petitioner notice and a pre-detention hearing before an immigration judge where respondents will have the burden to demonstrate a change in circumstances justifying petitioner's re-detention. Under the circumstances of this case, petitioner will not be required to post bond pursuant to Rule 65(c) of the Federal Rules of Civil Procedure. The parties are directed to meet and confer and, if possible, submit a joint proposed briefing schedule and hearing date with respect to any motion for a preliminary injunction no later than fourteen (14) days from the date of entry of this order.
