Judge Myong J. Joun: ELECTRONIC ORDER entered. On 1/9/26, Margaret Brouillard, a/k/a Margaret Maria Bankerthas, filed a petition for a writ of habeas corpus seeking her release from custody. To give the presiding judge time to consider the matter, and to ensure adequate access to legal counsel through these proceedings, unless otherwise ordered by the Court, Petitioner shall not be moved outside the District of Massachusetts without providing the Court 48 hours advance notice of the move and the reason therefor. District Judge Margaret R. Guzman: ORDER entered. ORDER TO SHOW CAUSE. Upon review of the Petition, the Court finds that it lacks jurisdiction over this Petition. Notwithstanding Petitioner's ties to Massachusetts, see, e.g., ECF No. 1 paras. 9, 11, the "general rule [is] that for core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement," Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004). Petitioner states that she is detained by Immigration and Customs Enforcement in Cumberland County Jail in Portland, Maine, i.e., in the District of Maine. See ECF No. 1 paras. 1, 11, 23. Accordingly, Petitioner is ordered to SHOW CAUSE as to why this Petition should not be dismissed for lack of jurisdiction by January 30, 2026. District Judge Margaret R. Guzman: ELECTRONIC ORDER entered granting 12 MOTION Waive 72-hour Advance Notice Period Before Transfer and Notice of Intent to Transfer. Respondents provide notice to transfer Petitioner to the Donald Wyatt Detention Facility in Central Falls, Rhode Island and seek waiver of the required 72 hours advanced notice prior to transferring the Petitioner outside the District of Massachusetts, see ECF No. 12. Petitioner assents to her transfer to Wyatt; however, she reiterates the importance of remaining in New England due to the pendency of her underlying criminal matter in Bristol County Superior Court (MA), see ECF No. 13. Accordingly, the Court GRANTS Respondent's motion for waiver, ECF No. 12, and adds the following: Petitioner shall not be transferred to a district outside of New England (MA, ME, NH, CT, RI, or VT) unless Respondents provide advance notice of the intended move. Such notice shall be filed in writing on the docket in this proceeding and shall state the reason why Respondents believe that such a movement is necessary and should not be stayed pending further court proceedings. Once that notice has been docketed, Petitioner shall not be moved out of the District where she is being held for at least 72 hours from the time of that docketing. Petitioner shall not be deported, removed, or otherwise transferred outside the United States until further order of this Court.
