TEXT ORDER: This matter is before the Court on Petitioner's Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241, D.E. 1 ("Petition") and request to issue on Order to Show Cause Why the Petition Should Not Be Granted. D.E. 1 ("Petition"). TEXT ORDER: This matter comes before the Court upon Petitioner Mamadou Oury Diallo's Petition for Writ of Habeas Corpus 28 U.S.C. § 2241, D.E. 1 ("Petition"), asserting he is unlawfully detained by immigration authorities under 28 U.S.C. § 1225(b) without a bond hearing, and that he is entitled to a bond hearing pursuant to 8 U.S.C. § 1226(a) and 8 C.F.R. § 236.1(d). Respondents filed a letter response, D.E. 6, stipulating to the facts alleged in the Petition, and acknowledging that they rely on the same statutory interpretation set forth in Matter of Yajure Hurtado, 29 I&N Dec. 215 (B.I.A. 2025), which this Court rejected in Lomeu v. Soto, Civ. No. 25-16589, 2025 WL 2981296 (D.N.J. Oct. 23, 2025). Petitioner filed a reply brief. D.E. 7 . Therefore, for the same reasons stated in Lomeu, the Court GRANTS the Petition. Respondents shall provide Petitioner a bond hearing as soon as practical but no more than 7 days from the date of this Order.
