MINUTE ORDER (Text Entry Only) The Court has reviewed the Petition filed under 28 U.S.C. § 2241 (Doc. 1 ) and the related request for emergency injunctive relief (Doc. 2 ). Petitioner asserts he unlawfully detained and has not been provided a bond hearing. He asserts that he has been held in custody since November 22, 2025-nearly two months ago. He offers little explanation why he did not seek relief earlier. For example, he admits that it has been the policy of ICE to deny substantive bond hearings since at least September 2025 (Doc. 2-1 at 5) or as early as July 2025 (Doc. 2-1 at 7). In addition, he asserts in his memo, that he arrived in this country in July 2024 (Doc. 2-1 at 4), but in his notice, he claims that he entered the country in 2017 (Doc. 2 at 4). Finally, he does not explain why his delayed action constitutes an emergency for this Court. Thus, the TRO request is untimely, and it is DENIED. See Local Rule 231(b). However, the filings raise serious questions as to the process Petitioner has received in relation his detention. Thus, the Court converts the TRO to a motion for preliminary injunction and refers the matter to the assigned magistrate judge to determine as soon as possible.No later than January 20, 2026, to the extent not already accomplished, Petitioner's counsel is directed: (1) to serve Respondents with a copy of the Petition, the motion for temporary restraining order, and accompanying papers, along with a copy of this Order and identifying Petitioner's name and A-file number, by e-mail to all appropriate recipients including the United States Attorney's Office for the Eastern District of California, with a copy to usacae.ecf2241-imm@usdoj.gov, and by overnight mail; and (2) promptly file proof of such service on the docket.
