PAPERLESS SUA SPONTE ORDER The petitioner has filed a notice of voluntary dismissal pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i) [ECF No. 12]. However, it is unclear whether the petitioner has the authority to notice a voluntary dismissal because the respondents have filed a response/answer to the petition [ECF No. 11]. See Johnson v. Fla. Dep't of Corr., No. 3:17-cv-878-J-34MCR, 2019 U.S. Dist. LEXIS 178905, (M.D. Fla. Oct. 16, 2019) (treating a response to a petition for writ of habeas corpus as an answer). Therefore, the parties shall brief whether the dismissal is effectual or whether a dismissal must be based on stipulation of the parties or Court order under Rule 41(a)(1)(A)(ii) or 41(a)(2).
