MINUTE ORDER by Chief Judge Philip A. Brimmer on 2/13/2026 re: 17 Joint Status Report. On January 26, 2026, the Court granted petitioner-plaintiff'ss habeas petition and ordered respondents to provide petitioner-plaintiff with a bond hearing within seven days of the date of the Court's order. Docket No. 14 at 11. The Court denied petitioner-plaintiff's motion for temporary restraining order and/or preliminary injunction as moot because it requested identical relief to the habeas petition. Id. at 10 n.4. On February 6, 2026, petitioner-plaintiff filed an emergency motion for immediate release, renewing motion for temporary restraining order and/or preliminary injunction. Docket No. 15 . The motion alleged that petitioner-plaintiff was granted bond, but that Immigration and Customs Enforcement ("ICE") was refusing to accept payment of the bond. Id. at 2. On February 9, 2026, the parties filed a joint status report informing the Court that, on February 6, 2026, ICE accepted payment of the bond and that petitioner-plaintiff was released from custody. Docket No. 17 at 2. The Court consequently denied the emergency motion for immediate release, renewing motion for temporary restraining order and/or preliminary injunction as moot. Docket No. 18 .
