Acting Deputy Field Office Director John Charpentier has declared that, in preparing his Declaration [ 22 ],he has "examined the official record available to [him] regarding [Petitioner]" and has "discussed this case internally with Officers within [his] office." Id. ¶ 4. As to the following statements, the Declarant shall state more specifically the source of the information provided, whether the source of the information has direct knowledge of the asserted fact, and whether the information is based in whole or part on a writing, and if so, shall provide a copy of that writing: id. ¶ 12 ("On July 4, 2025, Medford Police Department in Medford, Massachusetts arrested the Petitioner for shoplifting by concealing merchandise"); id. ¶ 13 ("On July 4, 2025, ICE encountered the Petitioner in Medford, Massachusetts after he posted bond out of Medford Police Department's custody"); id. ¶ 14 ("On July 4, 2025, ICE served the Petitioner with a Form I-862, Notice to Appear, a Form I-200, Warrant for Arrest of Alien, and a Form I-286, Notice of Custody Determination"); id. ¶ 15 ("On July 7, 2025, the shoplifting by concealing merchandise charge was dismissed at the request of the Commonwealth of Massachusetts"); id. ¶ 17 ("On July 21, 2025, ICE cancelled the Form I-286, Notice of Custody Determination, as it was issued in error because the Petitioner is not detained under 8 U.S.C § 1226. ICE also served the Petitioner with a Form I-261, Additional Charges of Inadmissibility/Deportability, alleging that he is also inadmissible pursuant to 8 U.S.C § 1182(a)(7)(A)(i)(I)").
