MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 6/8/2026: In Petitioner's 17 Notice Regarding Unconditional Bond Hearing, which the court construes as a Motion to Enforce the court's 14 Order, Petitioner argues that the bond hearing provided to him pursuant to the court's 14 Order was deficient because, as the bond "hearing was just in the beginning stages of the proceeding and appearances had just been made by the parties, Petitioner's video connection was lost" and was never restored. Petitioner contends that the Immigration Judge denied Petitioner's request for bond despite not hearing any argument from Petitioner. Thus, Petitioner seeks his immediate release. In their 20 Response to Petitioner's 17 Motion, Respondents concede that Petitioner's connection was lost due to a power outage at his detention facility, and that the Immigration Judge issued the Order denying bond after his connection was lost and without hearing from Petitioner. Respondents "do not oppose the Court ordering a new bond hearing" for Petitioner but oppose Petitioner's immediate release due to his conviction for drug trafficking offenses. The court agrees that the bond hearing provided to Petitioner did not comply with the court's 14 Order, but FINDS that a renewed bond hearing, not immediate release, is the appropriate remedy for the reasons stated in the court's 14 Order. On 6/5/2026, Respondents filed a 21 Status Report indicating that on 6/4/2026, Petitioner was provided another bond hearing at which the Immigration Judge vacated its prior bond determination, then denied Petitioner's release finding that Petitioner is a danger to the community and a flight risk. Thus, because Petitioner has already been provided the relief to which he is entitled, Petitioner's 17 Motion to Enforce is DENIED as having been rendered moot by the 6/4/2026 bond hearing.
