The Court finds that jurisdiction is proper notwithstanding the provisions of 8 U.S.C. § 1252(g) because the issue presented in the Petition is the constitutionality of Petitioner's detention and not the discretionary decision making of the Attorney General in the immigration context. Petitioner has been detained since November 16, 2024. The Court finds that continued detention is not reasonable under Zadvydas.
