District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The record before the Court indicates that petitioner Thias Varela Silva came to the United States over 20 years ago. Doc. No. 1 at 1. The respondents have represented to the Court that, at some point in 2004, she was detained and then released by immigration authorities and later, in absentia, ordered removed. Apparently, she led a relatively uneventful life in the United States since then, working as a housecleaner, and bearing and raising three children who are United States citizens. Recently, she was arrested by local authorities on an assault-and-battery charge against a family member. This week, a state-court judge reviewed the facts underlying the charge and released her on personal recognizance. Upon her release from state court, ICE arrested her. Varela Silva had been living with her adult child; her two younger children live elsewhere, with their father. ICE has no facility in Massachusetts in which it can appropriately detain women, so Varela Silva is being held in ICE’s Burlington office. Presently, the respondents are contemplating moving her in custody to Texas or elsewhere. Such a transfer would complicate her ability to defend against the pending state charges, and to assist her counsel in efforts to reopen her removal proceedings and to continue litigating this case. Under the totality of the circumstances, the Court ORDERS Varela Silva’s immediate release while the merits of her habeas petition remain under consideration. The Court ALLOWS the respondent’s request for a one-week extension in their deadline to answer the petition, making their answer now due January 16, 2026. (CAM) (Entered: 01/09/2026)
