Text of Order: On December 8, 2025, the petitioner filed an assented-to motion to amend his petition (doc. no. 30). Shortly thereafter, the court ordered the respondents to show cause, in part, why it should not grant relief under Destino v. FCI Berlin, No. 1:25-cv-374-SE-AJ, 2025 WL 4010424 (D.N.H. Dec. 24, 2025). The court subsequently ordered a bond hearing. The issues in the case have since developed to focus on whether the petitioner's bond hearing was conducted in accordance with the Constitution. Nonetheless, and in an effort to clarify the record, the court now grants the assented-to motion to amend the petition (doc. no. 30). Consequently, the respondents' motion to dismiss the petition (doc. no. 17) is denied without prejudice as moot. Cf. LR 15.1(c). So Ordered by Chief District Judge Samantha D. Elliott. ENDORSED ORDER granting 46 Motion to Clarify Order of 3_25_26. Text of Order: The petitioner's motion to clarify (doc. no. 46) is granted. The court's March 25, 2026 endorsed order belatedly granting the December 8, 2025 motion to amend (doc. no. 30) was intended to clarify the record. The notation that amended pleadings are due by March 27, 2026, merely reflected the pro forma requirement that the petitioner file the proposed amended petition that had been attached to the motion to amend (doc. no. 30-1) now that the motion had been granted. Nonetheless, the petitioner's request to file an amended petition that reflects the current posture of this case and the petitioner's current requests for relief is reasonable and may better clarify the record. On or before April 3, 2026, the petitioner may file an amended petition reflecting the case's current posture. Alternatively, the petitioner may simply file the proposed amended petition that was attached to the motion to amend (doc. no. 30-1) and the court will consider the amended petition in light of its subsequent order and the parties' filings (doc. nos. 34-45). The respondents are not required to answer unless directed to do so by the court regardless of whether the petitioner elects to file the amended petition that was attached to the motion (doc. no. 30-1) or an amended petition reflecting the case's current posture. In the event that the respondents desire to answer, they shall file a notice of their intent to do so no more than 48 hours after the petitioner files the amended petition, and their response within 5 days of the filing of the amended petition.
