MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 5/13/2026: In Respondents' 22 Opposition to Petitioner's 20 Motion for a Temporary Restraining Order, Respondents do not dispute that Petitioner's period of presumptively reasonable post-removal order detention established in Zadvydas v. Davis, 533 U.S. 678 (2001) has expired, and do not proffer any evidence showing that Petitioner's removal to his native Iran is reasonably foreseeable. Instead, Respondents argue that Petitioner is not entitled to relief because of his extensive criminal history, including his August 2025 arrest for carrying a concealed weapon that precipitated his present immigration detention. The Ninth Circuit has held, however, that a noncitizen's criminal history is irrelevant to the Zadvydas reasonable foreseeability analysis. Tuan Thai v. Ashcroft, 366 F.3d 790, 797 (9th Cir. 2004) (stating that the petitioners in Zadvydas had extensive criminal records, but "[t]he Zadvydas Court rejected the Government's arguments with respect to both aliens and held that § 1231(a)(6) simply did not authorize an alien's potentially indefinite detention, even if such detention were premised on 'protecting the community from dangerous aliens'") (quoting Zadvydas, 533 U.S. at 697); Yakoub v. Marin, No. 5:26-cv-01399-JAK, 2026 WL 922015 at *6 (C.D. Cal. Mar. 31, 2026) ("Under binding Supreme Court and Ninth Circuit precedent, a noncitizen's danger to the community is not material in the Zadvydas analysis."). To the extent Respondents contend that Petitioner poses a risk to community safety, their remedy is to release Petitioner on an order of supervision that accounts for this concern. Yakoub, 2026 WL 922015 at *6 ("As Zadvydas observed, public safety concerns can be addressed through appropriate conditions of supervision, rather than prolonged detention.") (citing Zadvydas, 533 U.S. at 700). Accordingly, Petitioner's 20 Motion for a Temporary Restraining Order is GRANTED as follows: (1) Respondents are ORDERED to IMMEDIATELY RELEASE Petitioner Valod Davoodi (A-071-762-387) as permitted under 8 C.F.R. § 241.5(a); and (2) Respondents are ENJOINED AND RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, which include, at a minimum, strict compliance with the requirements of 8 C.F.R. §§ 241.13(i) and 241.4(l). The Clerk of the Court is DIRECTED to serve this Order on the California City Detention Facility. This case is REFERRED to the assigned Magistrate Judge for further proceedings.
