PAPERLESS ORDER DENYING without prejudice 11 Motion to Stay Transfer (the "Motion"). In the motion, the Petitioner asks "this Court to stay venue transfer to the Middle District for two (2) weeks and issue a briefing schedule on the question of whether transfer is appropriate." Mot. at 1. Frankly, we aren't sure what the Petitioner is asking for here. This is a Section 2241 habeas petition. See generally Pet. The Petitioner originally filed another habeas petition before us on the same facts. "Section 2241 petitions" like these "may be brought only in the district in which the inmate is incarcerated." Fernandez v. United States, 941 F.2d 1488, 1495 (11th Cir. 1991). In that prior case, the Petitioner was then detained in a "a Collier County facility," which is in the Middle District of Florida. See Order Transferring Case, Lezama Garcia v. Field Office Director for Miami Field Office, U.S. Immigration and Customs Enforcement, No. 25-cv-23136 (S.D. Fla. Jul. 16, 2025) (Altman, J.), ECF No. 5 at 1. So, we transferred the case to the Middle District of Florida. Mere hours later, however, counsel called to tell us that the Petitioner had been moved to a detention facility here in Miami, Florida. Since his original petition had already been transferred, we instructed him to file another petition here, which he did. In this present petition, he says he's "detained at the Krome Service Processing Center in Miami, Florida." Pet. at 2. In this case, there's no pending motion to transfer venue to the Middle District of Florida. See generally Docket.
